Prosecutors Seek to Block 'Bunnie' (Andrew Huang) from 360 Modding Trial
>> From wired.com:
[QUOTE]
Celebrity geek Andrew “Bunnie” Huang, the designer of the Chumby and author of the 2003 title Hacking the 'Xbox: An Introduction to Reverse Engineering', has agreed to testify for a southern California man charged under the anti-circumvention provisions of the Digital Millennium Copyright Act.

The defendant in the case, 28-year-old Matthew Crippen of Anaheim, allegedly ran a business modding Xbox 360s for between $60 and $80 a pop. He was charged after he performed the silicon surgery for an undercover corporate security investigator with the Entertainment Software Association, then again for an undercover ICE agent. He faces up to three years in prison if convicted of both counts.

But if federal prosecutors have their way, the scheduled Nov. 30 trial in Los Angeles won’t include Huang’s testimony. Prosecutors earlier this month asked the judge presiding over the case to preclude Huang from testifying on the grounds that his testimony would be legally irrelevant. The government says fair use is not a defense (.pdf) to a DMCA charge, and argues that Huang’s legal opinions are inadmissible. A ruling is pending.

Xbox Live Silver Membership Name Change
>> From digitaltrends.com:
[QUOTE]
Microsoft has renamed its Xbox Live Silver Membership, which will now be called Xbox Live Free Membership, tweets Graeme Boyd, Xbox Community Manager of Europe. The changes come as part of the company’s overhaul of the Xbox.com site.

The new Xbox website already features the updated lingo, but the actual Xbox 360 console dashboard will not reflect the new wording until it is updated sometime this fall, reports JPS.

MS spends big to launch Kinect: Pepsi, Kellogg's, Youtube, ABC, Oprah, Ellen, ...
>> From nypost.com:
[QUOTE]
Backed by a half-billion-dollar budget, the tech giant is rolling out a major movie-style marketing blitz aimed at driving its motion-sensing device to the top of holiday wish lists.

Microsoft has struck a promotional partnership with Burger King. Roughly 400 million cans of Pepsi and Diet Pepsi will plug Kinect, along with 60 million cereal and snack boxes from Kellogg's.
Meanwhile, some 7,000 retailers will stay open past midnight on Nov. 4 -- the day Kinect goes on sale -- to stimulate demand.

Kinect will take over YouTube's home page and have a big presence on Nickelodeon and Disney digital properties.
TV spots, created by AgencyTwoFifteen, will pop up on ABC's "Dancing with the Stars" next Monday and on Fox's "Glee."
The print ad buy includes titles such as "People" and "InStyle," among others. Microsoft's Xbox team is also organizing a major outdoor event in Times Square, where many of the huge billboards will show Kinect ads.

There's a new trend in daytime talk: Tech gadgets. Last month the "rugged" Motorola Defy smartphone made its public debut on the 25th season premiere of "The Oprah Show." And now Microsoft's Kinect for Xbox 360 is traveling the TV talk circuit, appearing Tuesday, Oct. 19 on "Oprah," and later this month on "The Ellen DeGeneres Show."
